Terms and Conditions December Giveaway

1. General

The following terms and conditions for the “December Raffle” regulate the terms and conditions for participation in the “December Raffle” (hereinafter: “Raffle”) of Bitvavo B.V., business address at Keizersgracht 281, 1016 ED Amsterdam, The Netherlands (registered with the De Nederlandsche Bank (DNB), Spaklerweg 4, 1096) (hereinafter: “Bitvavo”).

By participating in the promotion, you accept and agree to these terms and conditions in full and without reservation. In addition to these terms and conditions, the “User Agreement” of Bitvavo shall apply without restriction.

By participating in the Promotion, you represent and warrant that you meet the eligibility requirements described in these Terms and Conditions. Failure to meet these requirements will result in you being excluded from the promotion. Bitvavo will decide on such exclusion. The decision is not contestable.

2. Duration

This promotion begins on December 1, 2024 at 00:00 (CET) and ends on December 23, 2024 at 23:59 (CET) (hereinafter: “Promotion Period”).

3. Eligibility requirements and registration

Participation is open to fully verified and registered clients of Bitvavo who:

1. Meet all requirements described in these terms and conditions,
2. Who have registered via the link in the invitation sent by email or app
3. Accept these terms and conditions by participating in the promotion.

To be eligible for the promotion, an existing user must

• Sign up using the link in the invitation you received by email or app; and
• Trade the minimum required amount for the week prize; or
• Trade the minimum required amount for the month prize, and invite at least one friend to register within the promotion period using his/her personal referral code. The referred friend must complete the identity and bank account verification process

To be eligible for the promotion, new users must

• Create a Bitvavo account and complete the identity and bank account verification process; and
• Sign up using the link in the invitation you received by email or app; and
• Trade the minimum amount required

Individuals or legal entities that provide market-making services or similar services, as well as institutional clients, are therefore not eligible to participate in this promotion.

Employees and immediate family members of employees of Bitvavo or its affiliates, parent companies, subsidiaries, participating advertising partners, advertising agencies and companies involved in the creation, production or implementation of this promotion are also not eligible to participate.

4. December Raffle

December Raffle: Users are eligible to win one of the prizes described below during the specified period if they meet the eligibility criteria. Prizes will be awarded at random to eligible participants on the day of the payout (see table below)

• Bitvavo will pay the 30.5% Kansspelbelasting due to the Dutch Tax Administration (Belasingdienst).

5. Notification and payout

There are no additional costs associated with this December Raffle.

The bonus will be automatically credited to the user's Bitvavo account on the dates specified in the table above. The exchange rate is determined based on the midprice on the Bitvavo exchange at 09:00 on the day of payment.

Winners will be notified via the app.

6. Exclusion from the promotion

Bitvavo reserves the right to exclude from the Promotion any Participant who is suspected or determined to have:

• Tampered with the entry process or the operation of the Promotion,
• Acted in collusion with other participants to manipulate or disrupt the Promotion,
• Violates these Terms and Conditions,
• Violates any other applicable terms and conditions of Bitvavo or its subsidiaries and other companies involved in the provision of Bitvavo’s service,
• Has provided inaccurate information.

Participants excluded from the Promotion are not eligible to receive the December Raffle or any other payouts or rewards under this Promotion.

Bitvavo is not responsible for the accuracy of the data provided by the Participant and may also exclude a Participant if the Participant's email address is invalid.

7. Limitation of liabilities

Bitvavo shall not be liable for any direct or indirect losses arising out of or in connection with this promotion. Bitvavo reserves the right to suspend, cancel or postpone the promotion if it cannot be carried out as planned for any reason whatsoever. It is not necessary to give reasons for suspending, cancelling or postponing the promotion. Participants have no legal claims against Bitvavo arising from or in connection with this promotion.

8. Data protection and taxes

Information on the use of personal data, its processing, purpose and duration of processing and the rights of participants under the GDPR can be found in Bitvavo’s Privacy Notice.

Bitvavo will pay the 30.5% Kansspelbelasting due to the Dutch Tax Administration (Belasingdienst). Participants are solely responsible for any other taxes incurred in connection with the payments or rewards from this promotion. It is recommended to consult a tax advisor to determine the tax implications of accepting a prize or reward.
